Delhi High Court Questions Validity of Sunjay Kapur’s Will Amid Growing Contradictions
The legal battle over businessman Sunjay Kapur’s estate intensified in the Delhi High Court this week. The court raised serious questions about the will presented by Priya Kapur. For two consecutive days, judges examined numerous errors and inconsistencies in the document.
Basic Errors Raise Suspicion
The court focused on fundamental mistakes in the will. These included misspelled names of family members. The document contained wrong gender references for some beneficiaries. It listed incorrect addresses for properties. The will also selectively named some beneficiaries while excluding others. Most importantly, it contained no inventory of Mr. Kapur’s substantial assets.
Priya Kapur’s legal team repeated earlier explanations but failed to provide new evidence. They could not prove that Sunjay Kapur had ever seen or approved the document. They offered no emails, messages, or notes from the industrialist about the will.
Template Theory Fails to Convince Court
The defense relied on what they called the template theory. Senior advocate Rajiv Nayar suggested the will used sections from the will of Sunjay’s mother, Rani Kapur. However, the court questioned this approach. Judges asked why a billionaire would use his mother’s will as a template without correcting basic factual errors.
The comparison between the two wills revealed more problems. Rani Kapur’s will was properly notarized and followed all legal procedures. Sunjay Kapur’s will, dealing with much larger assets, was neither notarized nor registered. This difference raised serious questions about the document’s authenticity.
Digital Evidence Creates More Doubts
Technical examination of the will file created additional concerns. The digital trail showed the document originated from a device with no connection to Sunjay Kapur. This finding contradicted claims that Mr. Kapur had created or approved the will.
The court also noted the delayed disclosure of the document. There were attempts to secure signatures before sharing the will with other parties. These timing issues added to the growing list of questionable circumstances.
Confusion Over Financial Matters
Another major issue emerged around financial arrangements. The defense tried to connect two separate matters. They linked children’s expenses under divorce terms with benefits from the RK Family Trust. The court clarified these were different obligations.
Payments under the divorce consent terms were mandatory responsibilities. These now fall to the estate. Despite claims of massive trust benefits worth Rs 2,000 crore, no money has reached the children. This contradiction remained unexplained.
Unanswered Questions Multiply
Across two days of hearings, the defense could not resolve key issues. They failed to explain why basic personal details were wrong. They could not establish Sunjay Kapur’s involvement in creating the will. They continued to confuse routine payments with trust assets.
The pattern of unresolved contradictions remained consistent throughout both hearings. The bench repeatedly noted the lack of clear answers from Priya Kapur’s legal team. The case continues as the court seeks more convincing evidence about the will’s validity.
