Delhi High Court Paves Way for Forensic Test in Sunjay Kapur Estate Battle
A major development has occurred in the high-stakes legal fight over the fortune of the late industrialist Sunjay Kapur. The Delhi High Court has made a significant observation that appears to clear the path for a forensic examination of his disputed Will. This move could dramatically alter the course of the inheritance battle involving an estate valued at over Rs 30,000 crore.
Court Signals End to Secrecy Over Will
On Tuesday, the court dropped a strong hint against maintaining secrecy around the key document. Delhi High Court registrar Gagan Deep Jindal stated clearly that “any party can inspect any document.” He referred to a previous order from September 10, 2025, which mandated that inspection must be allowed to either side in the dispute. This observation is seen as a direct signal that the inspection, and likely forensic testing, of Sunjay Kapur’s Will may now be unavoidable.
This potential testing has been a core demand from Kapur’s children, Samaira and Kiaan Kapur, since November. The children, from Kapur’s marriage to actor Karisma Kapoor, have pointed to alleged inconsistencies in the Will. They argue a forensic scrutiny is necessary to determine the document’s authenticity.
Legal Wrangling and a Key Adjournment
The latest hearing saw lawyers for Priya Kapur, Sunjay’s third wife and the named sole beneficiary in the Will, argue against the application for inspection. They questioned the maintainability of the children’s request. However, lawyers for the plaintiffs countered by noting that Justice Jyoti Singh’s September order had already clarified that inspection is permitted.
Faced with this argument, the defence sought a short adjournment. The Joint Registrar then scheduled the next hearing for February 5. On that date, the court will hear further arguments and is expected to dispose of the application for inspection and forensic testing. This sets the stage for a crucial decision next month.
Questions Swirl Around the Disputed Will
The entire legal storm centres on the Will itself. Its contents have sparked intense controversy and scrutiny. The document names Priya Kapur as the sole beneficiary, completely excluding Sunjay Kapur’s two children and his mother, Rani Kapur. This exclusion is a primary reason the family is challenging its validity.
Serious questions have been raised about the Will’s authenticity, the circumstances of its preparation, and even the signature of Sunjay Kapur. Adding a layer of intrigue is the role of Shradha Suri Marwah. She was named as the executor in the Will but has stated she was unaware of this appointment. She reportedly received the Will via email from an official of the Aureus Group.
Executor’s Role Under Scrutiny
The court is now closely examining Marwah’s position. During the hearing, the registrar granted her a “final 10 days” to file her rejoinder. This indicates that her unexpected role as executor will face detailed judicial examination. How she handles her duties and what she reveals could significantly impact the case.
All parties now await the February 5 hearing. The court’s decision on whether to allow a forensic test could be a turning point. For the investors and business observers following this saga, the outcome will determine who gains control of a massive industrial empire. The move towards transparency and testing suggests the final chapter in this inheritance drama is yet to be written.
