Bombay High Court Issues Gag Order in Kumar Sanu’s Defamation Case
The Bombay High Court has stepped in to protect veteran playback singer Kumar Sanu from what he claims are damaging public statements. On Wednesday, the court granted him interim relief in a high-stakes defamation suit worth 50 crore rupees, filed against his former wife, Rita Bhattacharya.
This legal action centers on interviews given by Bhattacharya in September 2025. She appeared on several popular YouTube channels, including Film Window, Viral Bhayani, and Siddharth Kannan. In these interviews, she reportedly made serious allegations about Sanu’s conduct during their marriage.
Court Orders Immediate Restraint on Statements
Justice Milind Jadhav issued a significant gag order. The order restrains Rita Bhattacharya and certain independent media platforms from making or circulating any statements alleged to be defamatory against Kumar Sanu or his family.
The court was clear in its directive. It has forbidden Bhattacharya and the named media houses from writing, speaking, posting, publishing, or disseminating any content about Sanu that could be seen as defamatory, false, or slanderous. This applies to any form or medium, including social media, print, and digital platforms.
Justice Jadhav observed that the interviews appeared to cross a line. The court noted that at some points, the content seemed to be a personal attack on the singer, using language that qualifies as prima facie defamatory.
Professional and Personal Harm Cited
Advocate Sana Raees Khan, representing Kumar Sanu, outlined the severe impact of the interviews. She informed the court that the alleged statements caused serious financial and personal harm to her client. A key consequence was the cancellation of pre-scheduled international shows.
Khan argued that Sanu’s professional standing and goodwill have been adversely affected. The suit claims the videos collectively garnered over 1.5 million views. This wide circulation allegedly led to a decline in professional opportunities and a surge in abusive social media comments.
The singer’s legal team also pointed out that his personality rights have been protected by the Delhi High Court in the past, reinforcing the need for this injunction.
Mediation Suggested as Case Proceeds
During the hearing, Advocate Atif Shaikh, appearing for Rita Bhattacharya, suggested an alternative path. He urged the court to refer the matter to mediation. Shaikh cited the recent marriage of the couple’s son as a reason to seek an amicable resolution.
The court recorded this request but emphasized that Bhattacharya must exercise immediate restraint. She must ensure no further reputational damage or insinuations are made against Kumar Sanu while the legal process unfolds.
The High Court directed Sanu’s lawyer to inform the court by the next hearing date whether the singer would be willing to participate in mediation. The court clarified that any such mediation would be without prejudice to Sanu’s legal rights and claims in the suit.
Next Steps in the Legal Battle
While granting injunctive relief against new statements, the court deferred a decision on another plea. Sanu’s legal team had asked for the deletion of the allegedly objectionable interviews already online. The bench stated it would consider this request after receiving formal replies from all defendants.
Several legal firms are involved in the complex case. Representatives for global platforms like Google LLC and Meta also appeared, as the suit involves content hosted on their services. The matter is scheduled to be heard next on January 28, where the possibility of mediation and the deletion request will be further discussed.
This case highlights the increasing legal scrutiny of content published on digital and social media platforms, especially when it involves serious personal allegations between public figures.
